Terms and Conditions

1. All advertising material shall be supplied by the Advertiser or his agent to the Publisher within FOURTEEN DAYS of the date of this Agreement, failing which the right is reserved to insert the Advertiser’s name, address, telephone number and business appearing overleaf only, in such type as the Publishers shall think fit.
 
2. Any editorial and/or advertorial accompanying any advertisement is specifically optional without charge and forms no basis of this agreement. Such material will only be inserted if received by the Publishers from the advertiser within FOURTEEN DAYS of the date of this Agreement. In any event the Publishers cannot be held responsible for any reason for non-insertion (Cl.7 & 8 apply).
3. The Client shall have the right to cancel any order in writing to be received at the office of Heartbeat Publications within FOURTEEN DAYS of the date of receipt of the order. Thereafter the Client shall not be entitled to cancel in any circumstances. Proof of postage of such cancellation must be provided upon request.
4. No terms or conditions are recognized other than those contained herein or endorsed hereon by the Publishers. It is clearly understood that this order may only be cancelled in writing within 7 days from the date of order, failure of which will result in a 50% cancellation charge (of the value of the order).
 
5. No monopoly can be given to any Advertiser for any trade.
 
6. Payment is to be made to the Publishers’ office at Suite 1339, 109 Vernon House, Friar Lane, Nottingham, NG1 6DQ (hereinafter called the Publishers’ Address). No outside Representative of the Publisher is authorised to receive payment or to agree any contra amount. No receipt shall be valid except the Publishers’ official receipt issued from the Publishers’ address.
 
7. Any special position specified in this Order cannot be guaranteed though the Publishers will endeavour to insert the advertisement in such special position. In the event of non-receipt of copy the Publishers reserve the right to alter the position of such a default insertion accordingly.
 
8. The placement of an order by the Advertiser or advertising agency on behalf of a client, constitutes an assurance that all necessary authority and permission has been secured in respect of the use of any text and/or pictorial representation.
 
9. The Publishers reserve the right to refuse to accept copy material, the wording of which they may consider unreasonable or detrimental.
 
10. Photographs and drawings as accepted by the Publishers are included in the charge mentioned on the face of this Order and must be supplied by the advertiser.
 
11. Although the Publishers will use their best endeavors to publish as soon as practicable no warranty is given as to the date of publication.
 
12. If the Publishers shall decide not to publish, they shall so inform the advertiser and shall refund in full all moneys paid by the advertiser, but the advertiser shall have no other claim whatsoever against the Publishers by reason of non-publication.
 
13. Should a dispute arise out of this contract, or in the event of non-payment, it is agreed that The Barnet County Court, London N3 should have exclusive jurisdiction to try, hear and determine all such issues, and that complete costs incurred would be recovered.
 
14. If after 14 days from invoice of agreed date, payment is not received at the Publishers’ address, a surcharge of 20% will be added to the value of this order. If additional collection procedures become necessary a further 10% will be added to cover this cost.
